Terms and Conditions

The terms for using Imtyaaz services: this website, the Imtyaaz WhatsApp Business Platform and Imtyaaz LMS.

Version 1.0 · Last updated ·

1. About these terms

These terms are an agreement between you and امتياز للتسويق الالكتروني ("Imtyaaz", "we"), Helwan, Cairo 11433, Egypt. Sections 1-12 apply to every Imtyaaz service. Sections 13-17 also apply to the Imtyaaz WhatsApp Business Platform, and sections 18-23 also apply to Imtyaaz LMS. By creating an account or using a service you accept these terms.

If your business has signed a separate agreement with Imtyaaz, that agreement prevails where it differs from these terms.

2. Our services

  • The Imtyaaz WhatsApp Business Platform lets businesses connect their own WhatsApp Business Account, send verification codes, transactional notifications and consent-based marketing messages, manage templates and consent, and receive delivery information.
  • Imtyaaz LMS is a learning platform for online courses, live classes, quizzes, assignments and certificates, on the web and in the Imtyaaz apps for iOS and Android.

3. Accounts

  • Give accurate information and keep it up to date.
  • Keep your password and API keys secret. You are responsible for activity under your account.
  • An Imtyaaz LMS account is for one person and may not be shared. Users under 18 need the consent of a parent or guardian.
  • If you sign in with Facebook or Google, that service's terms also apply to the sign-in.

4. Acceptable use

  • Do not break the law, infringe anyone's rights, or upload harmful, deceptive or offensive content.
  • Do not try to access other users' data or accounts, probe or overload our systems, or get around security, rate limits or other controls.
  • Do not copy, scrape, resell or redistribute the services or their content without our written permission.

5. Your content

You keep ownership of the content you upload or send. You give Imtyaaz a licence to store, process, display and deliver it only as needed to provide the services to you. You confirm you have the rights to the content you upload.

6. Our intellectual property

The Imtyaaz software, apps, brand and site content belong to Imtyaaz or its licensors. These terms do not give you any right to them other than to use the services as described here.

7. Privacy

Our Privacy Policy explains how we handle personal data. It forms part of these terms.

8. Fees and taxes

Prices are shown on the course page, at checkout or in your plan or order. Taxes are added where applicable. Third-party charges, such as Meta's WhatsApp charges or your bank's fees, are not included in Imtyaaz fees.

9. Availability and changes to the services

We work to keep the services available and announce planned maintenance. Some services depend on third parties we do not control, such as Meta, app stores, payment and live-class providers. We may change or improve features; if a change materially reduces a paid service, we will tell you in advance.

10. Liability

The services are provided with reasonable care and skill. To the extent the law allows, Imtyaaz is not liable for indirect or consequential loss, lost profits or lost data, and our total liability for any claim is limited to the amount you paid Imtyaaz for the service concerned in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

11. Suspension and termination

You can stop using a service and close your account at any time. We may suspend or close an account that breaks these terms or puts other users, the services or our relationships with providers such as Meta at risk, with notice where reasonable. Sections that by their nature continue after termination remain in force.

12. Governing law, changes and contact

  • These terms are governed by the laws of the Arab Republic of Egypt, and the courts of Cairo have jurisdiction.
  • We may update these terms. We will publish the new version on this page with its date and tell you about material changes in advance. Continuing to use a service after a change takes effect means you accept it.
  • These terms are published in Arabic and English. If they differ, the Arabic version prevails.

13. WhatsApp Platform: your WhatsApp Business Account and Meta

  • You own your WhatsApp Business Account. You must follow the WhatsApp Business Terms of Service, the WhatsApp Business Messaging Policy, the WhatsApp Commerce Policy and Meta's terms.
  • Meta bills WhatsApp message charges directly to the payment method on your WhatsApp Business Account. Imtyaaz fees cover the software and platform usage only and never include Meta's charges.
  • Meta may approve, reject, recategorize or pause templates, limit accounts, or change prices. Imtyaaz does not control those decisions.
  • You can disconnect Imtyaaz at any time from the Imtyaaz dashboard or from Meta Business Settings.

14. WhatsApp Platform: what you must do

  • Message only people who gave you their number and agreed to receive messages from your business. The opt-in must name your business, and you must keep evidence of it.
  • Use authentication templates only for verification codes, utility templates only for transactional updates, and marketing messages only for people who opted in to marketing.
  • Honor opt-outs immediately. Imtyaaz does this automatically for STOP replies and WhatsApp's marketing preferences; you must also honor requests made through other channels.

15. WhatsApp Platform: what you must not do

  • Use purchased, rented, scraped, harvested or shared contact lists.
  • Send spam, deceptive or illegal content, content WhatsApp's policies prohibit, or messages that impersonate someone else.
  • Try to get around rate limits, consent checks, template review or other platform controls, or generate artificial verification-code traffic.
  • Share your API keys outside your own systems.

16. WhatsApp Platform: data protection and your data

Imtyaaz processes your customers' personal data on your behalf and according to our Privacy Policy. You are responsible for having a lawful basis for the messages you send and for informing your customers. After your account ends you can export your data for 30 days, after which it is deleted except where the law requires us to keep it.

17. WhatsApp Platform: partner status

Imtyaaz does not claim to be a Meta partner, Tech Provider or Business Solution Provider unless and until Meta has confirmed that status.

18. Imtyaaz LMS: courses and access

  • When you enroll in or buy a course you get a personal, non-transferable right to access it through your account for the period shown on the course page.
  • Do not share your account, record, download or redistribute course content, or use it commercially, unless the course allows it. We may limit the number of devices signed in to one account.
  • Instructors may update course content. If a course you paid for is withdrawn before you could reasonably complete it, contact us.

19. Imtyaaz LMS: payments and refunds

  • Prices, installment plans and discounts are shown before you pay. Payments are processed by the payment provider you choose at checkout.
  • Refunds follow the refund terms shown on the course page or at checkout and the applicable consumer protection law. To request a refund, contact us from your account email.
  • Rewards, points, cashback and affiliate credits have no cash value unless stated, and we may change or end those programs with notice.

20. Imtyaaz LMS: instructors and organizations

  • Instructors and organizations are responsible for the accuracy, legality and rights of the courses, live classes and materials they publish.
  • You give Imtyaaz a licence to host, stream, promote and sell your published content on Imtyaaz LMS for as long as it is published and to keep it available to learners who already bought it.
  • Commissions and payouts follow the terms shown in your instructor or organization account.

21. Imtyaaz LMS: live classes and community

Be respectful in live classes, forums, comments and reviews. We may remove content or restrict accounts that harass others, spam, or break these terms.

22. Imtyaaz LMS: certificates

Certificates confirm that you completed a course on Imtyaaz LMS. They are not an accredited academic qualification unless the course page states otherwise.

23. Imtyaaz LMS: app stores

If you use the Imtyaaz app from the Apple App Store or Google Play, the store's terms also apply. Apple and Google are not responsible for the app or its content.
